Terms & Conditions Mena Dresses

Definitions
1. Mena Dresses: Mena Dresses, located in Amsterdam, registered under Chamber of Commerce number 86470485
2. Customer: The party with whom Mena Dresses has entered into an agreement.
3. Parties: Mena Dresses and the customer collectively.
4. Consumer: A customer who is also an individual and acts as a private person.

Article 1. Applicability
1. These terms and conditions apply to all orders placed through the webshop.
2. Customers agree to the general terms and conditions by placing an order.

Article 2. Prices and Payments
1. All prices at Mena Dresses are in euros, include VAT, and exclude any additional costs such as administrative fees, levies, travel, shipping, or transport costs, unless expressly stated otherwise or agreed upon otherwise.
2. All prices set by Mena Dresses for its products, disclosed on its website, may be changed at any time.
3. The customer must make payments prior to delivery. Payment can be made via iDeal, Credit Card, or PayPal.

Article 3. Orders and Agreements
1. The ordering process takes place via the website: the customer adds products to the shopping cart and confirms the order.
2. The agreement is only finalized once the customer has received a confirmation email from the webshop.

Article 4. Delivery
1. Delivery takes place while stocks last.
2. Online orders are delivered to the address provided by the customer. Mena Dresses is not responsible for any delays caused by incorrect information.

Article 5 Delivery Time
1. The delivery times stated by Mena Dresses are approximate and do not grant the customer the right to cancel the agreement or claim compensation for any delays, unless explicitly agreed otherwise in writing.
2. The delivery period begins once the customer has completed the (electronic) ordering process and received an (electronic) confirmation from Mena Dresses.
3. If the indicated delivery time is exceeded, the customer is not entitled to compensation or contract termination, unless Mena Dresses fails to deliver within 14 days after receiving a written request or if alternative arrangements have been made.
4. The delivery time within the Netherlands and Belgium is 1 to 2 business days.

Article 6 Shipping Costs
Shipping costs are the responsibility of the customer unless agreed otherwise.

Article 7 Right of Return and Withdrawal
1. A consumer has the right to exchange an online purchase or request a voucher equal to the purchase amount within a 14-day cooling-off period, without needing to provide a reason, provided that:
2. The product has not been used.
3. The product has not been washed.4. The product shows no signs of use or damage and remains in its original condition.
5. The 14-day cooling-off period, as mentioned in section 1, begins: The day after the consumer receives the product.
6. In the case of a pre-order, the consumer cannot cancel the order before delivery.
7. The consumer can notify their intent to exercise the right of withdrawal by emailing
info@menadresses.com.
8. The consumer must return the product to Mena Dresses within 14 days of notifying their right of withdrawal, otherwise, their right to withdraw will expire.
9. Mena Dresses reserves the right to reject a returned order if it believes the return does not meet the conditions outlined in Article 1 of this section.

Article 8 Exchanges
Exchanges of purchased items are only allowed if the following conditions are met:
1. The exchange occurs within 14 days of purchase.
2. The return must comply with the conditions outlined in Article 5. Sale items are not eligible for exchange.

Article 9 Packaging and Shipment
1. If the packaging of a delivered product is opened or damaged, the customer must ensure that the carrier or deliverer documents this before accepting the product. If this is not done, Mena Dresses will not be liable for any resulting damage.
2. If the customer arranges transportation of a product themselves, any visible damage to the product or packaging must be reported to Mena Dresses before transportation. Failure to do so will release Mena Dresses from liability for any damage.

Article 10 Idemnity
The customer agrees to hold Mena Dresses harmless from any claims made by third parties concerning the products and/or services provided by Mena Dresses.

Article 11 Liability of Mena Dresses
1. Mena Dresses is never liable for indirect and direct damages, such as consequential damages, loss of profit, missed savings, or damages to third parties.
2. All images, photos, colors, drawings, descriptions on the website or in a catalog are indicative and approximate and cannot lead to compensation and/or (partial)dissolution of the agreement and/or suspension of any obligation.

Article 12 Force Majeure
1. In addition to the provisions outlined in Article 6:75 of the Civil Code, Mena Dresses will not be held responsible for any failure to perform its obligations towards the customer in situations beyond its control, which hinder or make the fulfillment of these obligations either partially or completely impossible, or unreasonable.
2. The force majeure situation mentioned in section 1 includes, but is not limited to, events such as emergencies (e.g., civil war, uprisings, riots, natural disasters, etc.), defaults or force 16 majeure by suppliers, deliverers, or other third parties, unexpected power outages, internet, computer, and telecommunications failures, computer viruses, strikes, government actions, unforeseen transportation issues, adverse weather conditions, and work disruptions.
3. If a force majeure event occurs that prevents Mena Dresses from fulfilling one or more obligations towards the customer, those obligations will be suspended until Mena Dresses is able to resume fulfilling them.
4. After a force majeure event has lasted for at least 30 calendar days, either party may
terminate the agreement in writing, in whole or in part.
5. In the event of force majeure, Mena Dresses is not obligated to pay any compensation (damages), even if it has benefited from the force majeure event.

Article 13 Amendment of the Terms and Conditions
Mena Dresses reserves the right to change the terms and conditions at any time. Customers can view the most recent version on the website.

Article 14 - Assignment of Rights
1. The rights of the customer arising from an agreement between the parties cannot be assigned to third parties without the prior written consent of Mena Dresses.
2. This provision acts as a stipulation with property law effect as outlined in Article 3:83(2) of the Civil Code.

Article 15 - Consequences of Invalidity or Voidability
1. If any provision of these general terms and conditions is declared void or voidable, the remaining provisions will remain unaffected.
2. Any void or voidable provision will be replaced by a provision that most closely aligns with the original intent of Mena Dresses when drafting the terms and conditions.

Article 16 – Applicable Law and Jurisdiction
1. All agreements between the parties are governed solely by Dutch law.
2. In the event of any disputes, the Dutch court in the district where Mena Dresses is located shall have exclusive jurisdiction, unless otherwise required by law.
